Terms of Service

1. Eligibility

You must be at least 18 years old to use 3Allusion. The Services are for adults only and are not intended for minors.

By using 3Allusion, you represent and warrant that:

• you are at least 18 years old;
• you have the legal capacity to enter into these Terms;
• the information you provide to us is accurate and complete; and
• you will comply with these Terms, our Content Policy, and applicable law.

We may request age, identity, or other verification information where reasonably necessary to confirm eligibility, investigate complaints, prevent abuse, satisfy partner requirements, or comply with law.

2. Description of Services

3Allusion is an adult-only AI photo studio that allows users to generate, edit, enhance, and transform visual content using AI-powered tools, templates, and related workflows.

Some features may be experimental, limited, restricted by geography, unavailable to certain accounts, or subject to partner requirements. We may modify, suspend, or discontinue parts of the Services at any time.

3. Accounts and Security

You may need an account to use certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

If you believe your account has been compromised or used without authorization, contact support@3allusion.pro.

4. User Content and Output

User Content means prompts, uploads, reference images, edits, text, media, metadata, and any other content you submit to or through the Services.

Output means content generated, modified, or returned by the Services based on your User Content or instructions.

You are solely responsible for your User Content, your prompts and instructions, your use of Output, and ensuring that your use of the Services complies with these Terms, the Content Policy, and applicable law.

5. Rights, Permissions, and Consent

You represent and warrant that you own, control, or have obtained all rights, licenses, permissions, and consents necessary to upload, process, transform, generate from, use, and distribute your User Content and any resulting Output.

If any User Content or intended Output involves a real person's image, likeness, voice, body, identity, or other personal attributes, you represent and warrant that you have all permissions and consents required by applicable law and sufficient for your intended use.

This requirement is especially strict for intimate, explicit, or sexualized content.

6. Adult and Explicit Features

Adult or explicit features may be available only to eligible adult users and may be restricted by jurisdiction, trust signals, verification status, partner requirements, account status, or product rollout stage.

Access to adult features is a privilege, not a right. Hidden or unavailable user interface elements do not create permission to use a feature.

7. Prohibited Uses

You may not use the Services to create, request, upload, process, distribute, or facilitate:

• content involving minors or persons who appear under 18;
• sexualized depictions of a person who appears under 18, regardless of labels;
• non-consensual intimate imagery, whether real, synthetic, or AI-generated;
• sexual violence, coercion, assault, exploitation, trafficking, blackmail, or extortion;
• deceptive or harmful sexualized depictions of a real person;
• revenge porn, privacy-invasive sexual content, or identity misuse;
• copyright, trademark, publicity-right, privacy-right, or other rights violations;
• fraud, harassment, impersonation, stalking, hate, threats, or unlawful activity; or
• attempts to evade moderation, age restrictions, payment restrictions, verification, or safety controls.

8. Depicted-Person Complaints and Removal Requests

Any person who believes they are depicted in content processed, stored, or distributed through 3Allusion may submit a complaint or removal request through Report Abuse or by contacting support@3allusion.pro.

We may temporarily disable access to the relevant content while we review the request. If consent cannot be established, if consent is shown to be invalid, or if the content violates our policies or applicable law, we may remove the content and take related account action.

9. Moderation and Enforcement

We may review prompts, uploads, outputs, usage patterns, and transaction activity using automated and manual systems for trust and safety, abuse prevention, partner compliance, and legal compliance.

If we reasonably believe that you or your content violate these Terms, the Content Policy, applicable law, or partner requirements, we may refuse processing, remove or block content, suspend or restrict accounts, request verification or documentation, refuse transactions, or preserve evidence where appropriate.

10. Payments, Credits, and Refunds

Certain features are paid and may require prepaid credits or one-time purchases. Prices, taxes, fees, payment methods, billing entity, and statement descriptor will be shown at checkout.

Payments are processed by Lukas Dreiher and/or its designated payment processors, acquirers, facilitators, billing partners, or authorized resellers, depending on the payment flow, region, and product configuration in effect at the time of purchase.

Credits are digital prepaid units. Credits are generally consumed when processing begins or when a paid action is otherwise initiated. Used or partially used credits are generally non-refundable except where required by law.

Failed generations may qualify for support credits or remediation instead of a cash refund. Accounts restricted or terminated for fraud, abuse, or policy violations may forfeit remaining credits to the extent permitted by law.

11. Intellectual Property

The Services, including software, site design, trademarks, workflows, prompts, templates, and proprietary systems, are owned by or licensed to 3Allusion and protected by applicable law.

Except as expressly stated in these Terms, no rights are granted to you.

12. Privacy

Our handling of personal data is described in our Privacy Policy. By using the Services, you acknowledge that we may process prompts, uploads, outputs, account data, payment metadata, and complaint information for service delivery, moderation, fraud prevention, abuse handling, and legal compliance.

13. Disclaimer

The Services and all Output are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and accuracy.

AI-generated content may be inaccurate, offensive, biased, unexpected, or unlawful if misused. You are solely responsible for reviewing and deciding how to use any Output.

14. Limitation of Liability

To the maximum extent permitted by law, 3Allusion and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity arising out of or related to the Services or these Terms.

Our total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of:

• the amount you paid us in the three months before the claim arose; or
• EUR 100.

15. Indemnity

You agree to defend, indemnify, and hold harmless 3Allusion and its affiliates, officers, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Services, your User Content or Output, your violation of these Terms, the Content Policy, or applicable law, or your infringement of third-party rights.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice by posting the updated Terms on our website, updating the effective date, or using other reasonable means. Continued use of the Services after the updated Terms take effect constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of Austria, without regard to conflict-of-law principles, except where mandatory consumer law provides otherwise.
